Some useful conveyancing/ transfer terminology

 

1. Deed of Transfer: The all-important drafted deed by which the right of ownership of land is transferred from one person or legal entity to another. After Transfer, it is referred to as the Title Deed, and it is crucial to keep it safe as it serves as the owner’s title to prove his/her/their ownership of the land.

2. Leasehold vs Freehold: Leasehold property implies qualified or limited ownership, which after 1991 is not limited to a fixed period anymore, but it is property “in expectation of freehold”.
Freehold property is property over which there is no time limitation, and full ownership is enjoyed.

3. Conveyancer: An attorney who has passed specialized conveyancing examinations, has taken an oath of office and has accordingly been admitted by the High Court to practice as a conveyancer in SA. Also referred to as the transferring attorney.

4. Joint Estate: The estate of spouses married in a community of property.

5. Title: Any right, in respect of land, including the right of ownership and other real rights, e.g., a registered mortgage bond over the property.
